Air Quality Permitting
Storage and Transfer of Service Station Fuels
at Gasoline Dispensing Facilities
This General Permit allows for the construction,
installation, reconstruction, modification and operation of one or more pieces
of equipment used for storing and dispensing service station fuels at a single
gasoline dispensing facility.
The potential-to-emit (PTE) for the equipment covered
under this General Permit shall be 1.8 tons of VOC per year based on a maximum
annual throughput of six million gallons of gasoline per year.
I.
DEFINITIONS
The terms used in this General
Permit shall have the meanings given to them in N.J.A.C. 7:27 et seq., except
those listed below:
CARB means California Air Resources Board
CARB Certified System means a vapor recovery system, or each of the
components of a vapor recovery system, that has been certified by CARB
according to its Vapor Recovery Certification Procedure CP-201, as adopted
April 12, 1996, or certified by CARB according to its Vapor Recovery
Certification Procedure CP-201, as adopted July 25, 2001.
Existing
Gasoline Dispensing Facility means a facility that has
dispensed gasoline into any motor vehicle on or before June 28, 2003.
Gasoline
Dispensing Facility (GDF) means a facility consisting of one or more
stationary gasoline storage tanks together with dispensing devices used to fill
vehicle fuel tanks. This term includes
retail and non-retail service stations.
New Gasoline
Dispensing Facility means a facility that has not dispensed gasoline
into any motor vehicle on or before June 28, 2003.
Service Station Fuels means all grades of gasoline,
diesel fuel and kerosene.
Stage I Vapor Recovery means equipment controlling
emissions during gasoline transfers from transport trucks into facility storage
tanks by capturing the vapors in the transport truck and returning them to the
terminal for processing. (See Figure I)
Stage II Vapor Recovery means equipment controlling emissions
from vehicle fueling operations by capturing vapors at the vehicle fill pipe
and returning them to the facility storage tanks. (See Figure 2)
Unihose means, with respect to a gasoline dispenser at a
gasoline dispensing facility, a dispenser that has only one hose and one nozzle
per dispenser side which is used for dispensing all grades of gasoline.
This General Permit is issued
under the authority N.J.S.A 26:2C-9.2. This General Permit shall allow for
inspection and evaluation to assure conformance with all provisions of N.J.A.C.
7:27 et seq. An opportunity for public comment on this General Permit was
provided on February 18, 2003.
This General Permit covers one
or more pieces of equipment used for storing and dispensing service station
fuels, located at a single gasoline
dispensing facility which:

has Stage 1 vapor recovery equipment which complies with
NJAC 7:27-16.3 on all gasoline tanks at the facility; and
·
has Stage 2 vapor recovery equipment, which complies
with NJAC 7:27-16.3 on all gasoline dispensing equipment at the facility.
This General Permit covers one or more tanks used for storing and dispensing gasoline, diesel fuel, and/or kerosene.
(NOTE: Storage and dispensing of diesel fuel and kerosene is included in
this
General
Permit and does not require Stage 1 & 2 Controls.)

Gasoline Dispensing Facilities
exceeding six million gallons during any 12-month period cannot use this
general permit. Gasoline Dispensing
Facilities subject to 40 CFR 63 Subpart
R {National Emission Standards for Gasoline Distribution Facilities (Bulk
Gasoline Terminals and Pipeline Breakout Stations)} cannot use this General
Permit.
Transfer of gasoline into any receiving vessel having a maximum
capacity of 2,000 gallons or greater must be made through a permanently affixed
submerged fill pipe or bottom fill pipe.
Transfer of gasoline from any delivery vessel into any stationary
storage tank having a maximum capacity of 2,000 gallons or greater shall occur
only if such storage tank is equipped with and operating the following emission
controls:

A vapor control system that reduces the total applicable
VOC emissions into the outdoor atmosphere by no less than 98 % of the
applicable VOC by volume in the air-vapor mixture displaced during the transfer
of gasoline; and
·
A pressure/vacuum relief valve on each atmospheric vent
which remains closed during the gasoline transfer; or
·
A floating roof tank
Transfer of gasoline into any gasoline vapor laden vehicular fuel tank
must be made only if such operation is equipped with a vapor control system
that meets the following conditions:
·
A vapor control system that reduces the total applicable
VOC emissions into the outdoor atmosphere by no less than 95 % of the
applicable VOC by volume in the air-vapor mixture displaced during the transfer
of gasoline; and
·
The system prevents overfilling and spillage.
·
The
system has been California Air Resource Board (CARB) Certified and is operated
in accordance with manufacturers specifications.
·
Each
dispensing device and its nozzle(s) at an existing GDF shall be equipped with a
check valve in the dispenser nozzle on or before June 29, 2005.
·
Each
nozzle at an existing GDF with a vacuum
assist vapor control system shall be equipped with a splash guard that prevents
spillage during refueling on each nozzle at the facility on or before June 29, 2005.
·
Each
dispensing device and its nozzles at an existing GDF shall be designed to be
compatible pursuant to N.J.A.C. 7:27-16.3 (e) (4) (iii) on or before June 29, 2005.
·
Each
dispensing device at a new GDF that dispenses more than one grade of gasoline
shall utilize a unihose system if the GDF was constructed or reconstructed on
or after June 29, 2003.
·
Each
dispensing device and its nozzle(s) nozzle at a new GDF shall be equipped with
a check valve in the dispenser nozzle on or before June 29, 2003.
·
Each
nozzle at a new GDF with a vacuum assist
vapor control system shall be equipped with a splash guard that prevents
spillage during refueling on each nozzle at the facility on or June 29, 2003.
·
Each
dispensing device and its nozzles at a new GDF shall be designed to be
compatible pursuant to N.J.A.C. 7:27-16.3 (e) (4) (iii) on or before June
29, 2003.
The potential-to-emit (PTE) for Storage and Transfer of Service Station
Fuels at Gasoline Dispensing Facilities covered under this General Permit shall
be 1.8 tons of VOC per year based on a maximum annual throughput of six million
gallons of gasoline per year.

A Copy of the CARB Executive Order for each Stage 2 Vapor Recovery system
shall be maintained on site for the life of the equipment and made available

changes listed below must be recorded in either a log book or in readily accessible
computer memories listing a
description of the change and the
date on which it occurred. These
records shall be made available to the Department upon request: installation or
