General Permit

For

Perchloroethylene Drycleaning Facilities

 

This General Permit allows for the construction, installation, reconstruction, modification and operation of one or more of the following types of equipment located at a dry cleaning facility that uses 150 gallons or less of perchloroethylene (PERC) per 12-month period:

 

1.      Dry-to-Dry Machines that are equipped with a refrigerated condenser as the primary control and also equipped with a carbon adsorber on the cylinder outlet designed to reduce the PERC concentration below 300 ppm.

 

2.      Non-HAP VOC Dry-to-Dry Machines where the facility uses less than 1000 gallons of Non-HAP VOC solvent per 12-month period.

 

3.      One or more boilers or heaters which meet the definition of a significant source, with a combined maximum heat input of less than or equal to 3 million Btu/hour burning natural gas, propane, No.2 fuel oil, diesel, kerosene, or any combination of these fuels.

 

This general permit includes all equipment typically used by a PERC Dry Cleaning Facility.  An owner or operator should check to see if air pollution control permits are needed prior to the installation and operation of any equipment not described in this permit.

 

Each facility may possess only one GP-012 at any time. A facility wishing to change this General Permit by adding new equipment or modifying existing equipment must follow the procedure listed in Applicability, Section III of the General Permit.

 

 

I.                   Definitions

 

The following terms, when used in this General Permit shall have the following meanings, unless the context clearly indicates otherwise.

 

“Carbon Adsorber” means a bed of activated carbon into which an air- perchloroethylene gas-vapor stream is routed and which adsorbs the perchloroethylene on the carbon.

 

“Diverter Valve” means a flow control device that prevents room air from passing through a refrigerated condenser when the door of the dry cleaning machine is open.

 

“Dry cleaning” means the process of cleaning articles using perchloroethylene

 

“Dry cleaning cycle” means the washing and drying of articles in a dry-to-dry machine.

 

“Dry cleaning facility” means an establishment with one or more dry cleaning systems.

 

“Dry cleaning machine” means a dry-to-dry machine

 

“Dry cleaning machine drum “ means the perforated container inside the dry cleaning machine that holds the articles during dry cleaning.

 

“Dry cleaning system” means a dry-to-dry machine and its ancillary equipment

 

“Dryer” means a machine used to remove perchloroethylene from articles by tumbling them in a heated air stream

 

“Dry-to-dry machine” means a one-machine dry cleaning operation in which washing and drying are performed in the same machine.

 

“External combustion unit” means a steam-generating unit (boiler or heater) that generates steam to supply heat to an industrial process, institutional or commercial operation. This term does not include internal combustion engines, or boilers that serve electric generating units and cogeneration facilities.

 

“Filter” means a porous device through which perchloroethylene is passed to remove contaminants in suspension. Examples include, but are not limited to, lint filter (button trap), cartridge filter, tubular filter, regenerative filter, prefilter, polishing filter, and spin disc filter.

 

“General Operating Permit” means a permit that is issued by the NJDEP and meets the requirements of 40 CFR 70 and N.J.A.C. 7:27-22.

 

“General Permit” means a type of standardized permit and certificate, issued by the Department under N.J.A.C. 7:27-8.8.

 

“Internal combustion engine” mean either a reciprocating engine or a combustion turbine in which power, produced by heat and/or pressure that is developed in the engine combustion chamber(s) by the burning of a mixture of air and fuel, is subsequently converted to mechanical work.

 

“Hazardous Air Pollutant (HAP)”means a pollutant listed in Table B of N.J.A.C. 7:27-22 Appendix A.

 

“Maximum Achievable Control Technology (MACT)” means a standard or rule promulgated under 40 CFR 63.

 

 “Maximum heat input rate” means, for a given unit of fuel-burning equipment, its maximum steady state fuel firing rate, in BTU per hour of gross heat input as determined by the design rating of the equipment manufacturer.

 

“Muck cooker” means a device for heating perchloroethylene-laden waste material to volatilize and recover perchloroethylene.

 

“Non-HAP VOC solvent” means a solvent used for dry cleaning that is defined as a VOC pursuant to N.J.A.C. 7:27-22 and is not listed as a HAP in Table B of N.J.A.C. 7:27-22 Appendix A.

 

“Perceptible Leaks” mean any perchloroethylene vapor or liquid leaks that are obvious from:

(1) The odor of perchloroethylene;

(2) Visual observation, such as pools or droplets of liquid; or

(3) The detection of gas flow by passing the fingers over the surface of equipment.

 

“Perchloroethylene consumed” means the total volume of perchloroethylene purchased based upon purchase receipts or other reliable measures.

 

“Reclaimer” means a machine used to remove perchloroethylene from articles by tumbling them in a heated air stream

 

“Refrigerated Condenser” means a vapor recovery system into which an air-perchloroethylene gas-vapor stream is routed and the perchloroethylene is condensed by cooling the gas-vapor stream.

 

“Refrigerated Condenser Coil” means the coil containing the chilled liquid used to cool and condense the perchloroethylene.

 

“Steam generating unit” means fuel-burning equipment or combustion equipment that combusts any fuel in order to produce steam or to heat water or any other heat transfer medium.

 

“Still” means any device used to volatilize and recover perchloroethylene from contaminated perchloroethylene.

 

“Temperature Sensor” means a thermometer or thermocouple used to measure temperature.

 

“Transfer machine” means a multiple-machine dry cleaning operation in which washing and drying are performed in different machines. Examples include, but are not limited to:

(1) A washer and dryer(s);

(2) A washer and reclaimer(s); or

(3) A dry-to-dry machine and reclaimer(s).

 

“VOC” means " any compound of carbon (other than carbon monoxide, carbon dioxide, carbonic acid, metallic carbonates, metallic carbides, and ammonium carbonate) which participates in atmospheric photochemical reactions. For the purpose of determining compliance with emission limits or content standards, VOC shall be measured by test methods in the approved SIP (such as N.J.A.C. 7:27B-3) or 40 CFR Part 60, Appendix A, as applicable, or which have been approved in writing by the Department and are acceptable to EPA. This term excludes those compounds which EPA has excluded from its definition of VOC in the list set forth at 40 CFR 51.100(s)(1), which is incorporated by reference herein, together with all amendments and supplements.

 

“Washer” means a machine used to clean articles by immersing them in perchloroethylene. This includes a dry-to-dry machine when used with a reclaimer.

 

“Water Separator” means any device used to recover perchloroethylene from a water-perchloroethylene mixture.

 

II.                Authority

 

This General Permit is issued under the authority of N.J.S.A. 26:2C-9.2. It shall allow for inspections and evaluations to assure conformance with all provisions of N.J.A.C. 7:27 An opportunity for public comment was provided on August 4, 2003. 

 

This General Permit is issued in accordance with N.J.A.C. 7:27-8.1 et seq.  This General Permit is also designed to fulfill the requirements of a General Operating Permit consistent with N.J.A.C. 7:27-22 and 40 CFR 70.  The General Operating Permit will become operative one year after the United States Environmental Protection Agency (USEPA) requires Perchloroethylene Dry Cleaning Facilities to obtain an Operating Permit pursuant to 40 CFR 70 and N.J.A.C. 7:27-22.2 (a) 4. If this Permit becomes a General Operating Permit it will include a permit shield, pursuant to the provisions of N.J.A.C. 7:27-22.17.  This Permit does not include compliance schedules as part of the approved compliance plan in Section VIII.

 

All requirements in Section VIII, with the exception of requirement numbers 33-54, are effective immediately.  Requirement numbers 33-54 would become effective one year after the United States Environmental Protection Agency (USEPA) required Perchloroethylene Dry Cleaning Facilities to obtain an Operating Permit pursuant to 40 CFR 70 and N.J.A.C. 7:27-22.2 (a)4.  

 

III.             Applicability

 

This General Permit allows for the construction, installation, reconstruction, modification and operation of one or more of the following types of equipment located at a dry cleaning facility that uses 150 gallons or less of perchloroethylene (PERC) per 12-month period:

Each facility may possess only one GP-012 at any time. If a facility wants to make a change to a source which has been registered under GP-012, a new general permit registration is required, unless the changed source would remain within the class of sources which qualify for GP-012, and the source would continue to be operated in accordance with the parameters set forth in the option chosen in the registration.

 

IV.              Exclusions

 

This General Permit does not allow for the use of the following:

 

1.      PERC Dry Cleaning facilities using transfer machines

2.      PERC Dry Cleaning facilities using Refrigerated Condenser as the only means of controlling emissions

3.      PERC Dry Cleaning facilities using Carbon Adsorption as the only means of controlling emissions

4.      PERC Dry Cleaning facilities using more than 150 gallons per year of Perchloroethylene

5.      PERC Dry Cleaning facilities using more than 1000 gallons per year Non-HAP VOC solvent

6.      PERC Dry Cleaning facilities with a combustion source or combination of sources having a combined maximum rated gross heat input capacity of greater than 3 MM BTU/hr

7.      Emergency generators, fire pumps or any other internal combustion engine

8.      NSPS sources

9.      MACT sources other than Perchloroethylene Dry Cleaning

10.  Boilers or heaters that combust other commercial liquid fuels, such as No.4, No. 5 or No.6 fuel oil or any solid fuels; 

11.  Combustion sources burning non-commercial fuels including crankcase oil, spec-oil, or any other used oils, landfill or refinery gas, facility byproducts, or any other type of waste materials, exclusively or in mixtures with commercial fuels; 

12.  Indirect or direct-fired process heaters exclusively associated with a manufacturing process; or

13.  Incinerators, furnaces, kettles, crucibles, stills, roasters, re-boilers, engines, kilns, and other combustion units associated with a production process.

The ratio of Non-HAP VOC solvent purchased to dry weight of articles cleaned by a dry cleaning machine in each calendar year shall not exceed 9.9 pounds of Non-HAP VOC solvent per 220 pounds of dry weight of articles cleaned.

The ratio of Non-HAP VOC solvent purchased to dry weight of articles cleaned shall be monitored by calculations each month during operation.  The owner or operator shall calculate the ratio of solvent to dry weight of articles cleaned on the first day of every month by the following procedure:

 

1.        Sum the volume of all Non-HAP VOC solvent purchases (in gallons) made in each of the previous 12 months (use a consumption of zero for months in which there were no solvent purchases) and multiply by 8.5 lbs./gallon.

2.        Sum the number of loads cleaned in each of the previous 12 months (use a value of zero for months in which there were no loads cleaned) and multiply by the maximum capacity of the machine (in pounds).

3.        Divide the number calculated in 1 by the number calculated in 2.  This is the ratio of Non-HAP VOC solvent purchased to dry weight of articles cleaned

1.        The chemical name of the Non-HAP VOC solvent used by the dry cleaning machine

2.        The volume of Non-HAP VOC solvent purchased (in gallons) each month.

3.        The maximum capacity of the machine (in pounds).

4.        The number of loads of clothing cleaned each month.

5.        The calculations performed in the monitoring requirement including: the weight of Non-HAP VOC solvent purchased (in pounds), the dry weight of articles cleaned during the previous 12 months (in pounds), and the ratio of Non-HAP VOC solvent purchased to dry weight of articles cleaned.

 

All records must be readily accessible and available to the Department for a period of five years.

The owner or operator shall route the air-perchloroethylene gas-vapor stream contained within each dry cleaning machine through a refrigerated condenser maintained at a temperature not greater than 45 degrees F.
